With the passage of the National Firearms Act in 1934, America’s gun laws underwent a significant change. Previously, citizens were allowed to purchase and carry firearms only if they had a license from one of the six states that accepted such licenses. The act also grandfathered many existing gun owners who had held their licences for longer than five years. The 1934 act provided for the registration of all firearms and required all firearm buyers and sellers to undergo a background check. It also created the Federal Firearms License (FFL) system, which allowed licensed dealers to sell firearms only to those who had already passed an application and inspection process. Finally, it created the National Instant Criminal Background Check System (NICS), which allows law enforcement agencies to check criminal histories of potential purchasers before making any purchases. The success of these changes led Congress in 1938 to pass the National Firearms Act Amendments, which granted exclusive rights to shotguns, rifle grenades, shotgun shells other than buckshot and slugs with a weight greater than three grains per round, machineguns (machine-guns with stocks), pistols having ten rounds or less capacity per magazine except revolvers manufactured before 1907, single shot rifles not exceeding twenty-five rounds per magazine without stock or pistol grip but including any shotgun fitted with a revolving cylinder that measures no more than eighteen inches in diameter at its widest point and has three firing positions; muzzleloading artillery; black powder cartridges weighing four ounces or less per cartridge; destructive devices defined as “firearms designed for blasting purposes only”; short barreled shotguns having barrels not over eighteen inches in length when unloaded from the shoulder; common carriers carriage into or out of any State by peddlers engaging in this trade upon their own behalf without touching any goods so carried is now exempted [from state regulations]; importation into any State Except Hawaii shall be limited to fifty rounds total each time unless otherwise approved by local authorities [of such importing State]; interstate transportation between points within said States may be subject only to extraordinary conditions imposed by either party [*]
